- Delete. Although excuse defenses are certainly a real thing in the law, the phrase would be SoP to excuse defense. In criminal law, an "excuse" is merely a reason given why a person who has committed a criminal act should nonetheless be spared punishment for it (e.g. insanity, duress, mistake of fact, etc.).
