     E a chi sostiene che questo stato di cose “darebbe un vantaggio al pm rispetto al difensore” ribattono che la tesi “non ha alcun fondamento, perché i giudici guardano alla rispondenza agli atti e alla logica degli argomenti delle parti, e non certo alla posizione di chi li propone; se fosse fondato questo sospetto, anche il giudice dell’impugnazione non dovrebbe far parte della stessa carriera del precedente grado di giudizio”.

     To those who say that this state of affairs "would advantage the prosecutor over the defense," they reply that the claim "lacks foundation, because judges look at the relevance of the documents and the logic of the parties' arguments, and definitely not at the position of the people who propose them; if this suspicion were well-founded, even appellate judges should not be in the same career as their counterparts in the lower courts."
