Etymology[edit]
From ค้ำ (kám, “to maintain; to support”) + ประกัน (bprà-gan, “to ensure; to guarantee; to secure”).
Probably first used on 11 November 1923, when the first book of the Civil and Commercial Code of Thailand was promulgated.

- 1926, พระราชกฤษฎีกาให้ใช้บทบัญญัติแห่งประมวลกฎหมายแพ่งและพาณิชย์ บรรพ ๑ และบรรพ ๒ ที่ได้ตรวจชำระใหม่ ลงวันที่ ๑๑ พฤศจิกายน ๒๔๖๘:
- มาตรา ๖๘๐ อันว่าค้ำประกันนั้น คือ สัญญาซึ่งบุคคลภายนอกคนหนึ่งเรียกว่า ผู้ค้ำประกัน ผูกพันตนต่อเจ้าหนี้คนหนึ่งเพื่อชำระหนี้ในเมื่อลูกหนี้ไม่ชำระหนี้นั้น
