Etymology

From ค้ำ (kám, “to maintain; to support”) +‎ ประกัน (bprà-gan, “to ensure; to guarantee; to secure”).

Probably first used on 11 November 1923, when the first book of the Civil and Commercial Code of Thailand was promulgated.

     มาตรา ๖๘๐ อันว่าค้ำประกันนั้น คือ สัญญาซึ่งบุคคลภายนอกคนหนึ่งเรียกว่า ผู้ค้ำประกัน ผูกพันตนต่อเจ้าหนี้คนหนึ่งเพื่อชำระหนี้ในเมื่อลูกหนี้ไม่ชำระหนี้นั้น

     Section 680 As for suretyship, it is a contract by which a third person, called surety, binds himself to an obligee with the performance of an obligation when the obligor fails to perform it.
