     Section 88 [As for] a case in which the prosecutor is a private citizen, once the court has admitted the case and the person of the accused has been brought before the court, or [as for] a case in which the prosecutor is a public prosecutor, once the charge has been submitted to the court, the court may order detaining the accused or provisionally releasing [him].
